ROCHESTER - The Bay State woman who advised Mark Ross to give a Spalding High senior distraught over being stood up by her boyfriend what turned out to be a fatal dose of fentanyl to "shut her up" had her felony charges bound over to superior court for possible indictment on Monday.

Leslie Aberle, 31, of Salisbury, faces up to life in prison after being charged with conspiracy to commit possession of a controlled drug, witness tampering and dispensing a controlled drug death resulting.

Eve Tarmey, 17, died Oct. 17 of acute fentanyl poisoning, according to a coroner's report.

Tarmey's mom, Jazzmyn Rood, 41, and Ross were both high on heroin the night of Oct. 16 when Aberle took a chunk of heroin out of her bra, gave it to Ross and told him to let her have it to "shut her up," according to courtroom testimony by Rochester Police Detective Christopher Mangum.

Tarmey had gone with Aberle and Ross earlier in the day to Massachusetts to meet her boyfriend in Methuen, but when he didn't show, she went back to the Riviera Motel in Rochester, where she remained distraught about the failed rendezvous.

Back at the motel, Rood, Ross and Aberle all injected themselves with what they thought was heroin but was, in fact, fentanyl, according to court records and affidavits.

In an interview Ross told Mangum that Tarmey was "freaking out" about not meeting the boyfriend and wanted to get high.

Mangum said Ross told him Aberle took the heroin from her bra and gave some to him, adding, "give her this to shut her up."

Mangum testified Ross told him that Tarmey snorted the heroin and afterward she seemed calmer. Police affidavits note Ross awoke at 3:30 a.m. and found Tarmey dead.

Aberle defense attorney Stephen Jeffco argued that Ross' word couldn't be trusted as he had lied to police in his first interview.

However, in the end the case was bound over to Strafford County Superior Court where a grand jury will consider her indictment.
