Charges upgraded to negligent homicide in New Year's Eve crash

MILTON - The charges against an East Wakefield woman involved in a fatal crash in Milton on New Year's Eve have been upgraded to include negligent homicide, according to a State Police report sent on Thursday.

An East Wakefield man died at the scene of the crash when the vehicle they both were in rolled over on Route 125 near Exit 18.

A female subject located on scene and determined to be the driver was identified as, Dianne Jenner, 44, of East Wakefield. Jenner sustained minor injuries in the crash and was transported to Frisbie Memorial Hospital in Rochester where she was charged with felony aggravated driving while under the influence. The charge of negligent homicide-DUI was added later.

Police were called to the scene of the crash a little before 10 p.m. and found one vehicle, identified as a Mitsubishi Endeavor, about 50 feet off the north side of the roadway.

The front passenger, identified as Donald Thomas, 58, also of East Wakefield, was ejected from the vehicle and sustained fatal injuries. Thomas was pronounced dead at the scene.

Police said the Mitsubishi was traveling northbound on Route 125 when it lost control, left the roadway and rolled over.
