DOVER - A Rochester man has been indicted in the vicious beating of a Newmarket man on Lafayette Street more than two years ago.

Brett Tibbetts, 22, of 48 Lafayette St., was charged with second degree assault by a Strafford County grand jury earlier in April. A trial could come as soon as next month.

Prosecutors and police say Tibbetts along with two or more individuals recklessly caused serious bodily injury to the 37-year-old man on Jan. 8, 2017, when they punched and kicked the victim as he lay on the ground. The victim suffered a brain bleed, a type of stroke.

Also accused in the beating were Chris Greenwood, 22, and Stephen Reagan Jr., 24, also of Rochester.

According to an affidavit filed by Rochester Police shortly after the attack, a woman who lived at 48 Lafayette St. called police the day of the attack after finding the victim unconscious in her driveway.

The man had been viciously beaten and left unconscious in the driveway after being jumped by what he said were three men, according to the affidavit. The victim said he had gone to the house to return items to his ex-girlfriend, whom he had recently broken up with.

Officers spoke at the scene with Greenwood and Tibbetts, who said they'd seen two males running from the scene, the affidavit states.

Later the same day police went to the hospital to interview the victim, who confirmed he had gone to the address to return his ex-girlfriend's property but refused to give any more details on the attack.

The following day the victim came to the Rochester Police Department where he revealed that two individuals he knew as Brett and Chris helped bring in the items he was returning.

But then as he was near the rear of his vehicle and getting ready to leave, he said the two he knew - who turned out to be Greenwood and Tibbetts - and a third unknown male surrounded him and confronted him about an issue between him and his former girlfriend.

When he tried to walk away to get in his vehicle, he said either Greenwood or the unknown male punched him knocking his glasses off, the affidavit states. Then as he fell to his knees to find his glasses, "all the individuals began assaulting him on the ground until he "blacked out." The victim said he believed the three were kicking him repeatedly while on the ground.

A felony riot charge against Tibbetts was dismissed. A trial on the assault charge could come as soon as next month.

Meanwhile, a check of court records reveals that Greenwood has a probation violation hearing on May 6 regarding an unrelated charge.
