DeLemus lawyer hopeful bail hearing stays in N.H.

The defense attorney for a Rochester man indicted in a federal court in Nevada over the Bundy ranch standoff two years ago is hoping that an upcoming bail hearing allowing his release from jail pending trial will be in New Hampshire and not Nevada.

Jerry DeLemus of Rochester, a Tea Party activist and co-chair of the state Veterans for Trump group, was named in the March 3 indictment as a midlevel leader and organizer of the conspiracy, who, among other things: recruited, organized, trained and provided logistical support to gunmen and other followers and organized and led armed patrols and security checkpoints from April 12 till the end of May 2014.

While the actual standoff occurred on April 12 before DeLemus had arrived at the Bundy Ranch in Bunkersville, Nev., the indictment accuses him of organizing subsequent patrols to keep the feds from seizing Bundy's cattle.

DeLemus, whose initial request for bail was denied by a federal judge March 7, got a stay order days later keeping him in New Hampshire for now while his new attorney, high-profile defense lawyer Mark Sisti of Chichester, begins working on the case.

Sisti told The Lebanon Voice today that he is awaiting receipt of court transcripts from the original detention hearing before moving forward and asking the court for a second hearing.

"After we get the transcripts we'll formulate our next move," he said, adding the hopes are a second bail hearing will also be heard in New Hampshire rather than Nevada.

Meanwhile, over the weekend on an Internet podcast that also broadcasts on Manchester Public TV former state GOP leader and gubernatorial candidate Jack Kimball said DeLemus, despite sleeping "on a concrete slab with a three-inch mattress" at Strafford County Jail, was keeping his spirits high and hoping for the best.

During the interview on "Rock, Paper, Hand Grenades," Kimball called the violent multi-vehicle, guns drawn raid at DeLemus' Rochester condo March 3 "a dog and pony show" and said FBI agents could've just asked him to surrender and he would have.

Kimball, a Tea Party leader in the state, said DeLemus "is a peaceful guy, with no violations or arrests."
