Mom charged in daughter's OD death has trial postponed till June

CONCORD, N.H. - The Rochester mother charged in the overdose death of her daughter in October has had her trial date in federal court postponed until June.

Court records show defense attorneys for Jazzmyn Rood, 41, asked the court for more time to prepare their case. No specific date in June for the trial has been set.

The trial was to have begun on April 5, when the cases for the other two defendants, Mark Ross, 41, of Rochester, and Leslie Aberle, 31, of Salisbury, Mass., were also to have been heard. Their trials will go on as scheduled.

All three stand charged in the death of 17-year-old Eve Tarmey who died of acute fentanyl poisoning inside a Riviera Motel room the morning of Oct. 17.

Rood's federal charges include concealing knowledge and providing false information to police about the drug's distribution in the death of Tarmey, her daughter.

Ross, who is Rood's boyfriend, and Aberle, who traveled with Ross and Tarmey to Massachusetts to buy heroin, are charged with giving Tarmey a drug that caused her death.

Ross told police he thought he had bought heroin, not fentanyl.

The cases originated in state court before being transferred in January to federal court.

Ironically, Ross was working as a paid DEA informant at the time of Tarmey's death, according to court records. He collected some $2,000 during a 17-month relationship, which didn't end till several days after Tarmey died.

Ross and Aberle face 20 years to life if convicted in federal court, while Rood could face up to three years.

All three defendants are being held on no bail awaiting trial.
