Mom charged in daughter's OD death headed for PR bail

DOVER, N.H. - A Strafford County Superior Court judge ruled today that the woman charged in her daughter's October fentanyl OD death in October can be released from jail on personal recognizance bail as soon as Strafford County Community Corrections personnel deem her competent to enter their program.

Jazzmyn Rood, 41, of 11 Barker Court, Rochester, wearing brown jail garb, leg irons and handcuffs, said nothing during the bail hearing except occasionally confer quietly with her public defender.

Rood is charged with misdemeanor endangering the welfare of a child, felony conspiracy to commit possession of a controlled drug and felony reckless conduct placing another in danger in connection with the death of her daughter, 17-year-old Eve Tarmey, on Oct. 17 inside the Rivera Motel on Gonic Road.

Assistant County Attorney Tim Sullivan argued to have Rood's $10,000 cash bail continued since Rood had already defaulted in 2012 on a court appearance on drug charges in Massachusetts and because she was likely to use heroin again like she did in the days leading up to her arrest after her daughter's death.

He also said she had no income and had been deriving her income from criminal enterprise in drugs and prostitution, and would likely return to such patterns.

However, the public defender reasoned that at the age of 41, the only default Rood had was the one from 2012, that she had not been charged with the more serious "death resulting" charges as the other two defendants in the case and that her bail would not be converted to personal recognizance until Strafford County Community Corrections had vetted her on all accounts.

In the end, Judge Steven Houran decided that with the guidance and close monitoring by Stafford County Community Corrections, he would allow the cash bail to be converted to personal recognizance when Rood is deemed safe for release.

Strict guidelines such as random drug and alcohol testing, curfews up to and including house arrest, ongoing mental health evaluations and full compliance with all restrictions will be in effect or the PR conversion will be rescinded immediately.

After the hearing the public defender and Rood remained to sign some forms before she was led out by Sheriff's deputies.

Rood will remain at Strafford County Jail until her released is authorized by Strafford County Community Corrections.

The other two defendants in the case, Mark Ross of 479 Gonic Road, The Riviera Motel, Room 117 where Tarmy died; and Leslie Aberle, 31, of Salisbury, Mass., remain in jail on $50,000 and $25,000 cash bail, respectively. They are charged with felony conspiracy to commit possession of a controlled drug, felony tampering with witnesses and informants and dispensing controlled drug, death resulting, which could mean life in prison.
