Rye man found guilty in assault on 86-year-old nursing home resident

BRENTWOOD - A Greenland man was convicted of simple assault by a jury in Rockingham County Superior Court on Friday.

Hugh D. McIntyre, 69, was found guilty of inappropriately touching an 86-year old woman with the intent of taking advantage of her age or physical disability while employed as a custodial staff member at a residential care facility in Rye.

Additionally, the jury found McIntyre not guilty of sexual assault and abuse of a facility patient based upon the same conduct.

McIntyre's misdemeanor conviction carries the possibility of an extended term of imprisonment because the jury found that he intended to take advantage of the victim's age or physical disability. He will be sentenced on Dec. 12.

Senior Assistant Attorney General Sean Gill, who serves as the director of the Medicaid Fraud Control Unit and Attorney Stephanie Johnson prosecuted this case along with Investigator Robert Freitas.

Under New Hampshire law, the Attorney General is responsible for the prosecution of a health care facility employees charged with willful abuse, mistreatment or neglect of a patient.
