Arrest warrant lifted, sentencing in works in theft case

DOVER, N.H. - A bench warrant has been lifted and a new sentencing date is in the works for a Lebanon man who failed to show up for his sentencing last month on burglary and drug charges.

James Cullen, 45, with a last known address of 21 Pork St., and formerly of 32 Buffy St., Rochester, pleaded guilty to theft charges on June 27 and was supposed to show up at court on June 29 for his sentencing, which was postponed till June 30 at his request.

However, when he didn't show up on June 30, a bench warrant was executed, said Assistant County Attorney Meghan Hagaman.

On Wednesday, however, Hagaman said the June 30 failure to appear ended up also being on account of a medical issue, so the bench warrant was voided. She said a new sentencing date is in the works but not yet set by the court.

Cullen was indicted in March for allegedly stealing foreign currency and collectible coins during a burglary of the Rochester Flea Market on Milton Road in January.

He was indicted on burglary, possession of controlled drug Tramadol (an opioid pain medication) and falsifying physical evidence in that he allegedly "removed Tramadol tablets from a cigarette box and concealed them in his pants," according to court records.

The three felonies carry prison sentences totaling a maximum of 29 years.

He also faces a year in county jail in connection with a Jan. 11 arrest on possession of marijuana.

Rochester Police show several arrests for Cullen dating back to 2008, including drug possession, driving after suspension, shoplifting and burglary.

In May Cullen was indicted on a charge of theft by unauthorized taking in connection with a theft in Dover last August.
