City man alleged to have run car off road and into rock wall indicted

DOVER - A Rochester man has been indicted on a host of charges in connection with an incident in which he allegedly forced another car off the road and into a rock wall in April.

James M. Nesbitt IV, 42, with a last known address of 6 May St., Rochester, faces two counts of reckless conduct with a deadly weapon, a felony criminal mischief charge and being a felon in possession of a deadly weapon, a switchblade knife.

The incident occurred in Farmington on April 29 when, according to the indictment, he "recklessly engaged in conduct which placed or may have placed (two victims) in danger of serious bodily injury by using his Ford F-250 truck to hit and ram off the road the car (they)" were in.

The criminal mischief charge was for causing more than $1,500 of damage to the rock wall.

If Nesbitt were to be convicted on all four charges, he would face a maximum 28 years in state prison.

The September Strafford County grand jury indictments were handed down on Sept. 20 and released on Wednesday.

An indictment is not an indication of guilt, rather that enough evidence has been gathered to warrant a trial.
