City man arrested after refusing to leave fast-food eatery

ROCHESTER - A Rochester man was arrested on Thursday after he refused to leave the Wakefield Street McDonald's.

Rochester Police got involved after the fast-food eatery called to ask police to remove him for trespassing a little before 10 p.m.

But when the officer arrived, Robert Marmen, 57, of 48 Fernald Lane, who was standing at the front counter, refused to comply with the officer's request to step aside.

The officer tried to talk to Marmen, who then tried to walk away. At that point the officer advised him he was being detained, prompting Marmen to allegedly try to walk away again.

Ultimately the officer had to physically detain him.

Marmen was charged with criminal trespass, disorderly conduct and resisting arrest or detention, all Class B misdemeanors.

Bail was set at $2,500 cash pending his arraignment scheduled for later today.
