Former New Durham contractor indicted on theft charges

CONCORD - The Attorney Generals Office on Monday announced the indictment of a former New Durham contractor on theft charges.

Kevin Clague, 39, d/b/a Clague's Contracting and Design, LLC, of Alexandria, Ind., formerly of New Durham, has been formerly charged with felony theft by unauthorized taking.

The indictment alleges that between Sept. 9, 2019, and July 6, Clague "obtained or exercised unauthorized control over the money of two victims, with a purpose to deprive them thereof, and the value of the money exceeded $1,500."

The Class A felony is punishable by up to 7 ½ -15 years at the New Hampshire State Prison and/or a maximum fine of $4,000 for each charge. An indictment is not an indication of guilt but rather that enough evidence has been presented to move forward to trial.

Assistant Attorney General Gregory M. Albert of the Consumer Protection and Antitrust Bureau is prosecuting this case.
