DOVER - The Rochester man serving four to eight years for the brutal rape of a woman in August of 2021 will stand trial again next month for raping a juvenile female six months earlier.
Scott Barrett, 49, formerly of Charles Street, Rochester, had his final pretrial hearing on Wednesday before Superior Court Judge Andrew B. Livernois.
The six-foot-two, 330 pound Barrett is accused of five counts of aggravated felonious sexual assault between Jan. 1 and Jan. 31, 2021, during which he allegedly had sexual contact with the minor, all of which occurred in Rochester.
Each count carries a 10-20 years sentence.
Barrett was found guilty of three charges of aggravated felonious sexual assault (against a physically helpless victim) following a jury trial in Strafford Superior Court in April of 2024. He was sentenced in October of 2024 and remains incarcerated in a New Hampshire State Prison.
According to a State Sentencing Memorandum submitted by Strafford County Assistant Attorney Hannah E. Ward, a female companion of Barrett broke off a sexual encounter the night of Aug. 31, 2021, when she began to feel unwell, took a Tylenol and went to sleep.
Over the next few days she began to feel pain in her lower abdomen and confronted Barrett, who said he'd stopped shortly after she became unconscious, according to the memorandum.
But the victim's pain and concerns remained, and on Sept. 4, 2021, she decided to review footage from a camera located in her bedroom.
According to the sentencing memorandum, "While reviewing the recording (the victim) observed the defendant engaging in sexual intercourse and sexual conduct over a period of one hour, while (the victim) appears to be unconscious."
Barrett, who was charged by indictment first in August 2022, was also sentenced to two eight- to 16-year prison terms for two more charges of aggravated felonious sexual assault (physically helpless victim), all suspended for 5-10 years following his release.
Barrett, who was indicted on various charges connected with the case in August 2022, October 2022 and again in August 2023. faced up to 80 years in prison if convicted on all charges, which included witness tampering.
Although he is still serving his four to eight year sentence, Barrett will most likely be wearing civilian clothes when he appears in court during jury selection and trial.
Jury selection is set for March 2.
