Police identify gun used in shooting incident at Legion

ROCHESTER - Rochester Police continue to investigate whether charges might be brought in connection with a fight that occurred at the American Legion on Wednesday night.

Charges being contemplated are for assault after two people claimed they were hit or shoved during the melee; and a reckless conduct charge for an individual who fired off a round from a handgun into the ground outside the Eastern Avenue club.

The incident was called into police a little before 11 p.m., after the altercation between two male members that had begun inside moved outside, according to police.

Once outside a female also became involved in some type of altercation as well, police said.

One round from a Smith and Wesson 9 mm was fired into the ground, Rochester Police Capt. Jason Thomas said today.

Thomas added that, in all, four or five individuals were involved in the incident.

The female involved in the scuffle outside was taken to Frisbie Memorial Hospital for treatment of a possible head injury.

Thomas said the only likely way the individual who fired the round could escape a reckless conduct charge would be a claim of self-defense.

He said more interviews need to be conducted before the investigation is complete.
