Rochester woman indicted on revenge porn charge

DOVER - A Rochester woman faces up to 14 years in state prison after her recent indictment on revenge porn charges.

Ashley Sutton, 29, of 3 D'amours Ave., stands formally charged by a Strafford County grand jury on two counts of nonconsensual dissemination of private sexual images.

Sutton allegedly uploaded images of a female partner's breasts and buttocks on April 19, according to the indictment, which said that Sutton did so "purposefully, and with the intent to harass the depicted person."

The indictment also states Sutton should have known that the victim "had intended that the image was to remain private and knows or should have known that (the victim) has not consented to the dissemination."

Strafford County Attorney Tom Velardi said today that the images in question were uploaded to Facebook and were up "for a brief period of time" before being taken down.

He said the couple were not estranged and had been in an active relationship at the time of the incident.

The so-called revenge-porn statute was just made into law in New Hampshire last year. It is a Class B felony punishable by three and a half to seven years in state prison.

The Strafford County grand jury indictments were handed down on Dec. 17 and released on Wednesday.

An indictment is not an indication of guilt, only that enough evidence has been gathered to move forward to trial.
