Alleged victim considered herself a 'second wife' to ex-RPD officer on trial for rape

DOVER - The wife of the former Rochester Police officer accused of raping a woman in 2017 and trying to rape the same woman in 2019 told the court the alleged victim often said she considered herself a second wife to the defendant and that they'd had a longtime "emotional affair."
The trial of former Rochester patrolman and sergeant Randy Smith, 37, of Misty Lane, Rochester, continues today with the defense expected to present its case after the state rested its on Monday.
Smith is facing the possibility of 40 years in prison if found guilty on both charges.
Smith's wife testified on Monday that when she learned her husband had had an affair during a military deployment in 2017 she was devastated, but testified that the alleged victim felt she'd been cheated on, too, and temporarily moved in with her to help her cope with her husband's infidelity.
During this time she said they were very close, but that changed after the March 19, 2019, incident, when Smith is accused of throwing the alleged victim down on a couch at her Rochester home, tried to unzip her pants and put his hands under her blouse.
At the outset of the encounter, Smith kissed her on the mouth and she kissed back, she said, but only for a moment before she pushed him away. Moments later she testified that he shoved her onto the couch and tried to have sex with her, but she managed to get away and left.
About two weeks later, the alleged victim texted Smith's wife, "Do you think your husband would ever cheat on you again?" she texted, Smith's wife testified.
"No," she texted back.
"Well he came on to me and kissed me," the alleged victim replied.
Smith's wife said she was upset with her husband over the incident, but also soured on the relationship with her longtime close friend.
She said a couple of weeks later they mutually decided to end the friendship and dropped all contact.

The 2017 charge, which happened sometime during the year according to court documents, involved the defendant allegedly grabbing the alleged victim's hair, dragging her to her knees and performing a sex act on her.
The trial is expected to wrap up by Wednesday.
Rochester Police say Smith remains on administrative leave without pay pending the outcome of the trial.
