Civil complaint filed against Somersworth roofing company

CONCORD - The Attorney Generals Office announced that a civil complaint has been filed in Strafford County Superior Court against William Mourgenos, owner of A&M Roofing and Sons, and his son, Brian Mourgenos, alleging unfair and deceptive acts or practices in violation of the New Hampshire Consumer Protection Act.

A&M Roofing and Sons operates out of Somersworth,

The civil complaint alleges that William Mourgenos committed unfair and deceptive acts or practices against three separate consumers, in that:

· He failed to pay restitution to a consumer from Somersworth as required by an Assurance of Discontinuance;

· He accepted a deposit for materials from a consumer in Rollinsford, but did not use the consumer's money for the consumer's job, and he failed to refund the consumer's deposit even though he did no work, all of which violated the Assurance of Discontinuance; and

· He and Brian Mourgenos accepted a cash deposit from a consumer in Kittery, Maine, but did not do any work for the consumer on her property in Portsmouth and failed to refund the consumer when requested.

The claim against Brian Mourgenos alleges that he accepted the deposit from the consumer in Kittery and then failed to complete any work on the consumer's property in Portsmouth. He thereafter failed to provide a refund to the consumer.

The State is seeking restitution, civil penalties, legal fees, and injunctive terms in its civil complaint.
