Eastside man facing felony charges after spotted with handgun during DUI probe

ROCHESTER - An East Rochester man is facing felony charges after he was spotted with a handgun in his pocket during a DUI investigation in a credit union parking lot on Wednesday.

The incident unfolded as an officer responded to the Service Credit Union on South Main Street regarding a possible DUI related motor vehicle complaint.

It was reported that a white Chevrolet Tahoe had possibly hit a guard rail in the parking lot, Rochester Police Capt. Todd Pinkham said on Thursday.

"The driver did not appear to be impaired, however he was in possession of a handgun while talking to the officer, and the officer learned that he was prohibited from carrying a handgun," Pinkham added.

The subject, Kristopher E. Henner, 28, of 14 Gina Drive, was charged with being a felon in possession of a deadly weapon, a Class B felony that carries a maximum seven years in state prison.

Henner was convicted in 2016 on an organized retail theft charge.

He was booked and bailed on personal recognizance pending an arraignment.
