Man charged in 2019 Milton strangulation case gets deferred sentence

DOVER - An East Wakefield man pleaded guilty on Friday to felony assault and habitual offender charges as well as four misdemeanors including two counts of simple assault DV, resisting arrest and obstructing report of a crime.

Ricky Allen Davis Jr., with a last known address of Dearborn Street, was sentenced to 1½-4 years deferred for 1 year, and then further deferred/suspended for an additional period of 2 years on the felony charges. The second degree assault charge accused him of strangling a domestic partner.

He was was also sentenced to 12 months deferred for a period of 1 year, further deferred/suspended for an additional period of 2 years on the misdemeanor charges.

Assistant Strafford County Attorney Katelyn Henmueller said a deferred sentence is similar to a suspended sentence, but the burden is on the defendant to show cause to the court at the end of the deferred period as to why the sentence should not be imposed.

All of the charges stem from a domestic violence incident in Milton on July 23, 2019. The plea deal also includes he continue counseling and have no contact with the victim.

Two separate habitual offender charges that occurred in Rochester in June and July of 2019 were nol prossed.
