DOVER, N.H. - A Milton man has been indicted in a scheme to defraud Walmart by allegedly returning stolen items for gift cards in March 2014.

Kristopher Henner, 23, formerly of Pineland Park and currently incarcerated at the Strafford County Jail, is charged along with Nicole Perry, 20, of Felker Drive, Milton, in three incidents in which they sought to defraud the Rochester store: on March 14, 23 and 26.

In each instance Henner is alleged to have stolen the items after which Perry tried to return them for gift cards.

Henner is officially charged with three counts of organized retail crime enterprise, all Class B felonies punishable by up to seven years in state prison apiece.

Perry was indicted on the charges in November.

Henner has a lengthy rap sheet with local police including arrests for shoplifting in 2012 and reckless mischief and reckless conduct by Milton police in December 2014.

The Strafford County grand jury indictments were handed down Dec. 17 and released on Tuesday.

An indictment is not an indication of guilt, rather that a grand jury has found sufficient evidence to warrant a trial.
