'Only Fans' prosecutor not happy with light sentence, lack of sex offender registry

DOVER - The man whose obsession with a Somersworth woman led him to break into her home multiple times, steal her panties and take a video of her genitals as she slept soundly in her own bed will spend just a year in county jail, a lot less time than the prosecutor in the case was seeking.
Deputy County Attorney Emily Garod told The Rochester Voice on Thursday she asked Superior Court Judge Mark E. Howard to sentence Mauricio Guerrero, 22, of Bensalem, Pa., to three and a half to seven years in state prison, with six months off for completing a Sex Offender Program on one of the burglary charges. She additionally asked for a suspended four-eight years on several other burglary charges.
But on Wednesday Howard sentenced Guerrero to just 12 months in Strafford County Jail, with another 12 months suspended.
Since Guerrero was also convicted of violation of privacy, Garod wanted the court to order him to register as a sex offender, but a technicality in a statute didn't make it automatic.
"He was convicted of violation of privacy which means he would have to register as a sex offender for 10 years," Garod said. "However because he was also convicted of the burglary with the intent to commit violation of privacy he could not be convicted/sentenced on both. There's a legal provision in the burglary statute that says that."
Garod said despite the language of the statute, she still urged Howard to order Guerrero to register as a sex offender.
"I requested that the judge nevertheless order him to register as I believed the state had proven the burglary crime was sexually motivated in nature," she said. "The judge declined."
It took a Strafford County jury just six hours following a May trial to find Guerrero guilty on almost all of the charges he faced.
The trial proved painful to both Guerrero and his victim as she had to recount the shock and revulsion when she awoke to find the stalker standing in the hallway outside her bedroom staring at her moments before her mom called the police to say they may have an intruder in the house.
The pair's relationship began when Guerrero met her on her OnlyFans platform, an online portal where sex workers earn money by sharing private videos and images with clients.
After their relationship moved from OnlyFans to texts and Facetime, they exchanged thousands of messages, mostly about sex, but met in person only three times, once having sex shortly before Christmas 2021.
In all they spent about two hours in person, while Guerrero spent some 66 hours driving from Pennsylvania to New Hampshire and back about a dozen times. All of the trips were unannounced and came without consulting the victim, who often didn't even know he'd been there.
Following a police investigations the victim later learned that Guerrero had spent a couple of hours in her bedroom - from 2-4 a.m. - on Feb. 9, 2022, trying to get into her phone and viewing her childhood mementos before pulling back her bathrobe as she slept and taking a video of her bare vagina because he said he wanted "to see it one last time."
Guerrero, who testified in his own defense, made jurors suffer through an agonizing three hours of cross-examination during which he often spent minutes on end pondering Garod's questions before asking her to repeat the question and then pondering minutes more.
Two hours into the cross-examination Garod finally called him out.
"Why are you taking so long to talk?" a frustrated Garod demanded. "Is that cause you're thinking about your answer?"
"I'm trying to process your question and give the best answer," replied Guerrero.
Throughout the brutal cross-examination levied by Garod, Guerrero steadfastly recounted that he thought the Somersworth victim, whom he had met on the OnlyFans website just three months earlier, wanted him to break into her home, put a tracker on her phone and take pictures of her vagina while she slept heavily after drinking wine all night.
The first of seven unannounced visits to the victim's residence was on Dec. 7, 2021.
"And when you came up on Dec. 7 from Pennsylvania she said, 'Don't ever do this again," Garod said. "So after she said that you thought she wanted you to break into her house?"
Guerrero remained silent for a full minute and began mumbling.
"What was the question again?" he finally asked.
"You knew she didn't want you at her mom's house, right?"
"Yes," he said.
Garod also revealed a note sent by Guerrero to the victim soon after his arrest by Somersworth Police on Feb. 9, 2022.
She read the note aloud in court: "I don't know why I did this I'm s stupid," she read. "I didn't mean for this to happen to you."
"Nowhere does it say, 'I thought you wanted me to do this.'" Garod added.
Garod then recounted the two hours he spent in the victim's bedroom beginning around 2 a.m. on Feb. 9 when he is said to have gone through the victim's belongings including her phone which he tried desperately to get access to.
"You found her sleeping, you go in around 2 a.m. and you're in there for roughly two hours," Garod noted. You're wearing socks, tiptoeing around. When she does wake, she sees you in the hallway, you run to the attic and she texts you, "Are you in my fucking house?"
"You don't say I'm trying to make you happy. You cut a hole in the screen to get out an attic window. do you actually believe she wanted you there?"
"I don't know what she wanted from me," Guerrero testified.
Guerrero was facing up to 30 years in prison on two of the nighttime burglaries that occurred between Feb. 7-9, 2022.
