Reported 4th beating case suspect may never be ID'd

ROCHESTER - The third suspect in a brutal January beating case who allegedly used the victim's credit card to buy Chinese food the night of the incident remains at large today, according to Rochester Police.

Meanwhile, a fourth suspect named by the victim in court affidavits as the assailant who may have initiated the violence may never be identified.

A week after the Jan. 8 beating occurred in the driveway of 48 Lafayette St., Chris Greenwood and Brett Tibbetts, both 20, and of Rochester, were arrested charged with felony riot in the attack, which left the victim with a brain bleed.

The third suspect, Stephen Reagan Jr., 22, also of Rochester, but termed as a transient on Thursday by Rochester Police Capt. Jason Thomas, is still at large, wanted on felony counts of receiving stolen property and forgery for allegedly using the victim's credit card but not the actual beating.

According to the affidavit filed by Rochester Police Officer Thomas Powers who led the investigation, a woman who lives at 48 Lafayette St. called police Jan. 8 after finding the victim unconscious in her driveway and took him inside.

The man, from Newmarket, had been viciously beaten and left unconscious in the driveway after being jumped by what he said were three men, according to an affidavit. The victim said he had gone to the house to return items to his ex-girlfriend, whom he had recently broken up with.

Powers, who responded to the scene, said the Good Samaritan said she had seen two individuals running down Moores Court toward Lafayette Street after the incident.

Officers also spoke at the scene with Greenwood and Tibbetts, who also said they'd seen two males running from the scene, the affidavit states.

Later the same day Powers said he spoke at the hospital with the victim, who confirmed he had gone to the address to return his ex-girlfriend's property but refused to give any more details on the attack.

The following day the victim was out of the hospital and came to the Rochester Police Department to let Police know more details of the attack. According to the affidavit, he said that two individuals he knew as Brett and Chris helped bring in the items he was returning.

But then as he was near the rear of his vehicle and getting ready to leave, he said the two he knew - who turned out to be Greenwood and Tibbetts - and a third unknown male surrounded him and confronted him about an issue between him and his former girlfriend.

When he tried to walk away to get in his vehicle, he said either Greenwood or the unknown male punched him knocking his glasses off, the affidavit states. Then as he fell to his knees to find his glasses, "all the individuals began assaulting him on the ground until he "blacked out." The victim said he believed the three were kicking him repeatedly while on the ground.

However, the two already arrested in the case have not been cooperating with police regarding any third suspect at the scene, and Thomas said on Thursday police also have no way now to tie Reagan to the scene, either, adding there's no proof revealing how he may have acquired the victim's credit card.

Greenwood remains out on bail, while Tibbetts is being held at Strafford County House of Corrections on $5,000 bail.
