DOVER - A Rochester woman has been indicted in the baseball bat attack of a man in late August.

Erika L. Benner, of 36 Farmington Road, Apt. #2E7, faces up to seven years in state prison on a charge of reckless conduct with a deadly weapon in the Aug. 28 assault that occurred in Rochester.

According to court documents, Benner "recklessly engaged in conduct which may have placed (the victim) in danger of serious bodily injury by means of a baseball bat ... when Benner did swing the bat at (the victim) and nearly struck him in the head."

The November indictments were released last Monday.

An indictment is not an indication of guilt, rather that enough evidence has been gathered to warrant a trial.
