Victim of alleged rape is developmentally disabled, affidavit says

DOVER - Police say the Dover teenager raped by a Rochester man is developmentally disabled and unable to give consent to sex due to her condition, according to a doctor who has evaluated and treated her.

Andy Williams, 43, of 36 Farmington Road, is charged with aggravated felonious sexual assault in connection with his visit to the 19-year-old's Dover home on May 17.

Williams was in court today for his arraignment following his arrest on Friday morning by Dover Police.

A police affidavit obtained by The Rochester Voice indicated that Dover Police were first called to the victim's home on May 17 where they learned that she was developmentally disabled and the parents had been awarded court-ordered custody.

The victim's father told police that he arrived home and found Williams in the victim's bedroom and that his pants and underwear were pulled down as were his daughter's.

The father then ordered Williams out of the house and spoke with his daughter, who confirmed she and Williams had had sex.

He later texted Williams, "You know we can call the police. What were you thinking?" to which Williams replied, "I want to marry her," the affidavit states.

Both parents said they had known Williams for years, and he was well aware of her condition.

The victim was given an in-depth interview during which she said Williams "grabbed me" and "told me to take my pants down," adding "without my permission he just had sex with me."

The victim's doctor, who practices at the University of Vermont Medical Center, said it his medical opinion the victim does not have the ability to consent to sex, the affidavit states.

The victim's psychoeducation assessment from Dover Schools further documented her "cognitive disabilities," the affidavit pointed out.

Williams' bail was continued at $50,000 cash, but can be converted to personal recognizance if he is accepted into the Strafford County Community Corrections program.
